1. INTRODUCTORY PROVISIONS
1.1. These General Terms and Conditions (hereinafter referred to as the “GTC”) govern the rights and obligations of the travel agency CK PURA VIDA TRAVEL s.r.o., ID No.: 19427417, with its registered office at Nám. Interbrigády 815/6, Bubeneč, 160 00 Prague 6, registered with the Municipal Court in Prague under file no. C 386375 (hereinafter referred to as “the Travel Agency”) and the customer under the tour contract (hereinafter referred to as “the Tour Contract”);
2. TOUR CONTRACT
2.1. The TA provides the customer with a tour based on a valid and effective TC, the content of which is divided in practice into several documents: (i) the Tour Confirmation or the Tour Contract form, (ii) these General Terms and Conditions, and (iii) the tour description in the Tour Operator’s catalog or other promotional material, including their online versions (hereinafter referred to as the “Tour Contract”). All of these documents are binding on the contracting parties. The text of the Trip Confirmation takes precedence over these GTC and the trip description in the catalog or other promotional material. The Travel Agency reserves the right to change the detailed description of the trip prior to the conclusion of the Travel Contract.
2.2. If the SoZ is not concluded in writing, the Travel Agency shall provide the customer with a Tour Confirmation in text form, e.g., as a PDF, upon conclusion of the contract.
2.3. The document required for the customer to join the tour is proof of payment together with the Tour Confirmation, the completed standard-form Travel Contract, or an exchange voucher for tours with self-arranged transportation.
3. CONCLUSION OF THE CONTRACT
3.1. The sale of a tour is understood to be the moment the Travel Contract is concluded. The Travel Contract is concluded at the moment the customer bindingly confirms the tour offer during communication with the travel agency. A binding confirmation of the tour offer is considered to be
– the customer’s signature on the submitted standard travel contract form within the deadline specified by the travel agency;
– other express consent by the customer to the travel agency’s offer or to the draft contract, as recorded in email, telephone, or other communication.
3.2. By entering into the Travel Contract, the customer certifies that:
- he/she has been provided with the travel agency’s General Terms and Conditions, which form an integral part of the Travel Contract; that he/she has familiarized both himself/herself and the other travelers with these terms and conditions; and that all customers agree to them;
- has been provided with information detailing the tour;
- has been provided with proof of the travel agency’s insolvency insurance;
- has been provided with the relevant form pursuant to Decree No. 122/2018 Coll., on model forms for individual types of tours and related travel services,
- was provided with general information on passport and visa requirements for the trip, including approximate processing times for visas (applicable to EEA citizens), or was referred to his or her relevant diplomatic mission to obtain this information (third-country nationals), as well as information on the destination country’s health requirements,
- was provided with the contact information for the travel agency’s representative (usually the tour operator)
- was informed of the identity of the operating air carrier or carriers, if already known,
- is authorized to enter into the Travel Contract, not only on his own behalf but also on behalf of persons who have apparently authorized him to do so. If the customer enters into the Travel Contract under a power of attorney on behalf of other persons, those persons are responsible for fulfilling the obligations, and the customer is liable for the fulfillment of their obligations. If the customer enters into the Travel Contract for the benefit of third parties, the customer is responsible for fulfilling the obligations under the contract, including timely payment of the tour price and provision of the necessary information. If the customer enters into the Travel Contract for the benefit of a person under 18 years of age, the customer declares that he or she is the person’s legal guardian or, if the minor’s consent is insufficient, that he or she has the minor’s consent or the consent of the minor’s legal guardian.
3.3. Unless otherwise stated, the travel agency’s tours are not suitable for persons with limited mobility.
3.4. Unless otherwise specified, the tour leader’s services are provided in Czech or Slovak.
3.5. Unless otherwise specified, the tour guide’s services are provided only at the destination.
4. DETAILED TRAVEL INSTRUCTIONS AND DOCUMENTS
4.1. The travel agency shall deliver detailed travel instructions to the customer by appropriate means no later than seven days before the start of the tour. These include information essential for the trip, particularly details regarding scheduled departure times, check-in deadlines (if applicable), scheduled stop times, transportation connections, and arrival times, which were not provided to the customer prior to the conclusion of the Travel Contract. Within the same timeframe, the travel agency shall provide the customer with the necessary receipts, vouchers, and travel documents, in particular an airline ticket or other document required for the trip. If the travel contract is concluded less than seven days before the start of the trip, the travel agency shall fulfill these obligations upon conclusion of the travel contract.
5. TOTAL PRICE OF THE TRIP AND METHOD OF PAYMENT
5.1. The price of the tour is the total price, which includes taxes, fees, and other similar monetary payments, as well as any additional costs that may arise. If additional costs cannot be reasonably quantified prior to the conclusion of the Travel Contract, the Travel Agency shall specify the types of additional costs that the customer may still incur.
5.2. The tour price is stated in the standard-form Travel Contract or in the Tour Confirmation. Prices are listed inclusive of VAT.
5.3. The tour price includes the services expressly listed for the tour in the catalog or other promotional material.
5.4. Unless otherwise specified in the Travel Contract, the customer agrees to pay the travel agency the price of the trip as follows:
- a reservation deposit on the date the Travel Contract is concluded in the amount of 5,000 CZK per person
- a deposit within 8 days of signing the Travel Contract in the amount of 40% of the tour price per person or the price of the airline tickets, whichever is higher;
- the balance of the tour price no later than 45 days before the start of the tour.
5.5. In the event of failure to pay the balance, the travel agency has the right to withdraw from the travel contract. In this case, the customer will be notified in writing, and the deposit received, reduced by the termination fee specified in Article 9, will be refunded. Failure to pay the balance does not constitute notice of withdrawal from the travel contract.
5.6. If the Travel Contract is concluded less than 40 days before the tour departure or the provision of services, the customer is required to pay the tour price at the time the Travel Contract is concluded.
5.7. The customer may pay the tour price directly to the travel agency (in person in cash or by credit card—if accepted by the travel agency—by bank transfer, or by money order) or to an authorized representative of the travel agency.
5.8. The customer’s financial obligation is fulfilled on the day the payment is credited to the travel agency’s account or on the day the travel agency receives the payment.
6. AMENDMENTS TO THE CONTRACT
6.1. The travel agency reserves the right to make minor changes to its contractual obligations. The travel agency is required to notify the customer of such changes in writing in a clear and understandable manner. Minor changes do not entitle the customer to withdraw from the Travel Contract. A minor change does not entitle the customer to a discount.
6.2. The following are considered minor changes:
- changes in passport and visa requirements for travel or changes in health requirements for participating in the tour;
- a change in the type of bus from a standard bus to a minibus;
- a postponement of air tours by up to four days due to a change in the flight schedule;
- a postponement of bus tours by one day;
- an adjustment to the tour duration by up to two days due to a change in the flight schedule;
- cancellation of a departure or pickup location where fewer than four tour participants are registered;
- a change in the departure airport.
6.3. If the customer requests a change to the contract, the travel agency’s consent is required. For administrative changes—such as cancellations or additional bookings of supplementary and optional services, or a change in the departure location less than 80 days before departure—the travel agency charges 300 CZK for each such change. Other changes, such as a change in the departure airport, a change in accommodations, etc., are considered a withdrawal from the contract and a proposal by the customer to enter into a new contract. In this case, the customer is obligated to pay the travel agency the applicable cancellation fee.
6.4. If external circumstances compel the travel agency to substantially alter any of the main terms of the travel services, or if the travel agency is unable to meet the customer’s special requirements, the customer may either accept the proposal or withdraw from the Travel Contract within the timeframe specified in the Travel Contract without having to pay compensation for early termination of the contract. The withdrawal period must not be shorter than five days and must end before the start of the tour. Upon submitting a proposal to modify the contract, the travel agency shall provide the customer, in a clear, comprehensible, and unambiguous manner and without undue delay, with the following information in written form: a) the impact of the proposed changes on the price of the tour, b) the period within which the customer may withdraw from the Travel Contract, c) the consequences for the customer if they do not withdraw from the Travel Contract in a timely manner, and d) details regarding any alternative trip and its price. If the customer does not withdraw from the Travel Contract within the specified period, they are deemed to have consented to the change to the contract.
6.5. If, in the situation described in Section 6.4, the quality or cost of the tour is reduced as a result of a change to the terms of the Travel Contract, the customer is entitled to a reasonable discount.
7. THE CUSTOMER’S RIGHT TO ASSIGN THE CONTRACT
7.1. If a third party meets the conditions for participation in the tour, the customer may assign the Contract to that third party. A change in the identity of the customer is effective vis-à-vis the travel agency if the customer delivers timely written notice of such change to the travel agency, together with a statement from the new customer confirming that they agree to the concluded travel contract and that they will meet the conditions for participation in the tour. Notice is considered timely if it is delivered at least 7 days before the start of the tour.
7.2. The travel agency shall inform the customer of the actual costs associated with the transfer of the travel contract; these costs must not be unreasonable and must not exceed the costs actually incurred in transferring the travel contract, and the travel agency shall provide the customer with documentation of these costs.
7.3. The customer and the new customer are jointly and severally liable to pay the balance of the tour price and to reimburse any additional costs incurred by the travel agency in connection with the change in the customer’s identity (in particular, this may include the travel agency’s handling fee and a fee for changing the airline ticket).
8. WITHDRAWAL FROM THE CONTRACT
8.1. The customer may withdraw from the travel contract at any time prior to the start of the trip; however, the travel agency may do so only if the trip has been canceled or if the customer has breached their obligations.
8.2. The travel agency may cancel the trip:
a) due to failure to reach the minimum number of customers. Unless expressly agreed otherwise, the trip is contingent upon reaching a minimum of 30 customers for bus tours and 8 customers for air tours; the travel agency is required to provide notice of failure to reach the minimum number of customers within the following timeframes: 1. twenty days before the start of the trip for trips lasting longer than six days, 2. seven days before the start of the tour for trips lasting two to six days, 3. forty-eight hours before the start of the tour for trips lasting less than two days;
b) the travel agency is prevented from fulfilling its obligation by unavoidable and extraordinary circumstances.
8.3. The customer materially breaches his or her obligations, in particular, by failing to pay a deposit, a balance, or the full price of the trip even after being requested to do so, by failing to arrive at the departure point on time, by repeatedly failing to follow the tour leader’s instructions, or by otherwise seriously disrupting the course of the trip or stay.
8.4. The customer is obligated to pay the travel agency a cancellation fee in the amount specified in Section 9.1 below in connection with the cancellation.
8.5. The customer is not required to pay a cancellation fee if the reason for withdrawal is: a) external circumstances force the travel agency to substantially alter any of the main components of the travel services included in the tour; b) the travel agency is unable to meet the customer’s specific requirements that it had accepted; c) unavoidable and extraordinary circumstances have arisen at the destination or place of stay, or in its immediate vicinity, which have a significant impact on the provision of the tour or on the transportation of persons to the destination or place of stay; d) The travel agency withdrew after canceling the tour due to failure to reach the minimum number of participants; e) The travel agency withdrew after being prevented from fulfilling its obligation by unavoidable and extraordinary circumstances and notified the customer of the tour’s cancellation without undue delay before the tour began. In these cases, the travel agency is obligated to refund to the customer, without undue delay and no later than 14 days from the date of withdrawal from the Travel Contract, all payments made by the customer or credited to the customer’s account. In the situations described in subparagraphs (c), (d), and (e), the travel agency has no obligation to compensate the customer for damages.
8.6. Withdrawal from the Travel Contract takes effect upon delivery of the notice of withdrawal to the other contracting party.
9. CANCELLATION FEES
9.1. The amount of the cancellation fee is determined based on the tour price specified in Article 5.2, without any discounts, and on the number of days between the withdrawal from the Travel Contract and the start of the tour, taking into account the Travel Agency’s actual costs. The start of the tour is defined as the start of the provision of travel services included in the tour.
The cancellation fee per person is as follows:
- More than 120 days before departure – actual costs incurred and 5% of the trip price, with a minimum of 500 CZK
- 19–7 days – actual costs incurred and 80% of the tour price after deducting actual costs incurred;
- 119–60 days – actual costs incurred and 20% of the trip price after deducting actual costs incurred;
- 59–30 days before departure – actual costs incurred and 50% of the tour price after deducting actual costs incurred;
- 29–20 days before departure – actual costs incurred and 60% of the tour price after deducting actual costs incurred;
- 6 days or less – 100% of the tour price.
9.2. If the customer fails to show up on the day of departure, misses the departure, or does not take the tour without first canceling the Travel Contract, the travel agency is entitled to compensation in the amount of the full tour price.
9.3. “Actual costs incurred” refers to the travel agency’s operating costs and contractually agreed-upon or legally mandated compensation to domestic and foreign service providers. The travel agency advises customers that, in the case of air travel packages, the actual cost incurred is the price of the airline ticket already paid.
9.4. Travel insurance is not included in the tour price and is governed by the terms of the relevant insurance policy. As a rule, the insurance premium is non-refundable and is added to the cancellation fee.
9.5. If the customer has already made a payment or a partial payment under the Travel Contract and the Travel Agency is entitled to a cancellation fee, the mutual claims will be offset; The travel agency will, if applicable, refund the customer the amount paid to date, reduced by the cancellation fee, or the customer will immediately pay the travel agency the difference between the cancellation fee and the amount paid to date, whichever claim is higher.
10. RIGHTS ARISING FROM DEFECTIVE PERFORMANCE OF THE TOUR (COMPLAINT PROCEDURE)
AND ASSISTANCE IN CASES OF DIFFICULTY
10.1. The travel agency is responsible for the proper provision of the tour and is obligated to provide the customer with assistance in cases of difficulty.
10.2. The tour is considered defective if any of the travel services included in the tour are not provided in accordance with the Travel Contract.
10.3. If the tour has a defect, the customer is required to report it to the travel agency without undue delay, ideally on the spot. The customer shall also specify a reasonable deadline for remedying the defect, unless the travel agency refuses to remedy the defect or immediate remedy is necessary. The customer also has the right to report the defect through the travel package sales agent.
10.4. The travel agency shall remedy the defect in the travel package, unless this is not possible or remedying the defect would entail unreasonable costs in light of the extent of the defect and the value of the travel services in question. If the travel agency fails to remedy the defect within the specified time limit, the customer has the right to remedy the defect themselves and demand reimbursement of the necessary costs. If the defect is substantial, the customer may withdraw from the Travel Contract without paying a withdrawal fee.
10.5. If material defects in the tour occur after departure, the travel agency shall offer, at no additional cost to the customer, a suitable alternative solution—if possible, of the same or higher quality than that agreed upon in the Travel Contract—so that the tour may continue; this also applies in cases where the customer’s return to the place of departure is carried out by a means other than that agreed upon. If the proposed alternative solution is of lower quality than that specified in the Travel Contract, the travel agency shall provide the customer with a reasonable discount. The customer may reject the proposed alternative solution only if it is not comparable to what was agreed upon in the Travel Contract or if the discount provided is not reasonable. In this situation, if the tour includes transportation, the travel agency is obligated to provide the customer, without undue delay and at no additional cost to the customer, equivalent transportation to the place of departure or to another location agreed upon by the contracting parties.
10.6. If, due to unavoidable and extraordinary circumstances, the customer’s return cannot be arranged in accordance with the Travel Contract, the travel agency shall bear the costs of necessary accommodations, if possible in an equivalent category, for a maximum of three nights per customer. The travel agency may not invoke unavoidable and extraordinary circumstances if, under applicable Union law, the relevant carrier cannot invoke such circumstances.
10.7. If the tour is defective and the customer has reported the defect without undue delay, the customer is entitled to a price reduction commensurate with the extent and duration of the defect. If the customer requests a price reduction, they should submit their request to the travel agency or intermediary without undue delay after the tour ends. The statute of limitations for the customer’s right to a price reduction is two years.
11. ADDITIONAL OBLIGATIONS OF CUSTOMERS
11.1. The customer is obligated to:
- possess a valid travel document that meets the requirements for visiting the destination countries and territories;
- comply with all health requirements mandated by the destination and transit countries, such as mandatory vaccinations;
- provide the travel agency, well in advance, with the number of the travel document they will use for the trip, and if they fail to do so, pay any additional costs incurred as a result;
- actively seek information about changes to passport, visa, and health requirements in the destination country;
- comply with the laws of the countries visited
- purchase medical expense insurance for the duration of the trip, either independently or through the travel agency;
- report to the meeting point specified by the travel agency;
- follow the instructions of the tour leader and sports instructors, adhere to the established itinerary, and, in the case of an individual itinerary, inform the tour leader of their planned route (the tour leader has the right to prohibit this route if the participant lacks sufficient experience or equipment);
- submit consent from a legal guardian if a person under 18 years of age is participating in the tour unaccompanied, and ensure that persons under 15 years of age are accompanied and supervised by an adult participant throughout the tour;
- if the travel agency is arranging visas, provide the travel agency representative with the information from their travel document by the deadline set by the travel agency;
- behave during the tour in accordance with the cultural customs of the visited country and act in a manner that does not damage or negatively impact nature and the surrounding environment;
- For cycling tours, follow the travel agency’s instructions for securing bicycles against damage.
11.2. A customer participating in a sports program is further obligated to:
- Refrain from consuming alcohol and addictive substances;
- Assess their physical and mental fitness for the specific part of the tour program;
- Take care of rented equipment and protect both their own equipment and that of other customers;
- Strictly follow the instructions of the sports instructor.
The customer acknowledges that the tour leader or sports instructor is authorized, for the purpose of ensuring customer safety, to exclude a customer from the sports program or prohibit them from participating in the planned itinerary.
11.3. The customer with whom the Travel Contract has been concluded is obligated to ensure that all customers participating in the tour fulfill the aforementioned obligations at their own expense.
11.4. A breach of the above obligations may constitute a material breach of the Travel Contract by the customer, for which the customer may be excluded from the tour without entitlement to a discount or a refund of the tour price.
12. LIABILITY FOR DAMAGES AND INJURY
12.1. The customer is obligated under all circumstances to act in a manner that prevents damage or injury to themselves, other customers, the Travel Agency, and its business partners. In accordance with this rule, for example, the customer should not join the tour if they show signs of a contagious disease.
12.2. The Travel Agency is liable for damage and harm caused by a breach of its obligations or those of its service providers. The Travel Agency is not liable for damage caused by the Customer, a third party not involved in the provision of services, or an extraordinary, unforeseeable, and insurmountable obstacle arising independently of the provider’s will.
12.3. If an international treaty to which the Czech Republic is a party permits a limitation on the amount of compensation for damages arising from a breach of contractual obligations or on the conditions for compensation, the Travel Agency shall pay damages only up to the amount of such limitation. The travel agency’s liability for damages is limited to three times the total price of the tour, except in cases of damages caused by the travel agency’s fault or injury to a customer’s health. The statute of limitations for a customer’s right to compensation for damages is 2 years.
12.4. The customer is required to report the loss, damage, or delayed delivery of luggage during air travel to the carrier immediately upon discovering the issue.
12.5. If the travel agency incurs damages due to a breach of obligation by the customer—such as costs incurred in connection with assisting a sick or injured customer, resolving the loss of the customer’s travel documents, arranging additional transportation and accommodations in that context, or damage to accommodations or a means of transportation—the customer is obligated to compensate the travel agency for such damages.
13. INSURANCE
13.1. The Travel Agency recommends that customers purchase insurance (cancellation insurance) to cover costs associated with terminating their obligations under the Travel Contract. In the case of sports trips, customers are required to purchase insurance providing assistance, including repatriation in the event of an accident, illness, or death (travel insurance). Customers may purchase this insurance through the Travel Agency from Česká podnikatelská pojišťovna, a.s., Vienna Insurance Group
13.2. The Travel Agency is insured against bankruptcy with Česká podnikatelská pojišťovna, a.s., Vienna Insurance Group, with its registered office at Pobřežní 665/23, Prague 8, 186 00, tel.: +420 957 444 555.
14. PROTECTION OF PERSONAL DATA
14.1. The Customer acknowledges that the Travel Agency is authorized, for the purposes of fulfilling the Travel Contract and complying with legal obligations, to process the Customer’s personal data, including, in particular: first name, last name, date of birth, necessary passport information as specified in the Travel Contract, bank account information, residential address, and, if applicable, other contact addresses, email address, phone number, flight number, PNR code for the flight reservation, and information regarding allergies, medications, and other health conditions. All personal data will be stored only for the period specified by law or for as long as strictly necessary.
14.2. For the purposes of fulfilling the Travel Contract, the information specified in Section 14.1 will also be provided, to the extent necessary, to the travel agency’s suppliers (in particular, hotels, transportation companies, and tour guides). The identifying information regarding these suppliers is specified primarily in the Travel Contract and the trip instructions; alternatively, the customer will receive this information no later than during the trip. If the tour destination is located outside the European Economic Area, the customer acknowledges that their personal data will be provided to recipients of personal data in that third country (in particular, hotels and foreign partners) or in another third country (in particular, airlines). Information regarding whether a European Commission decision on adequate protection of personal data exists in connection with the transfer of personal data to a third country will be provided by the travel agency upon the customer’s request.
14.3. The customer acknowledges that the travel agency will process his or her personal data—including first name, last name, address, phone number, and email address—for the purpose of sending commercial communications. The travel agency is authorized to send commercial communications via SMS, MMS, email, or regular mail, or to convey them by phone. The Customer may object to receiving commercial communications at any time, either by writing to the Travel Agency’s address or by sending an email to hello@go2prague.com. In such a case, the Travel Agency will no longer send commercial communications to the Customer or otherwise process the Customer’s personal data for direct marketing purposes.
14.4. The provisions of Article 14 set forth above apply mutatis mutandis to persons on whose behalf the customer has entered into the Travel Contract (travel companions). By entering into the Travel Contract, the customer declares that he or she is authorized to grant consent on behalf of the travel companions, whether based on contractual or other representation. 14.5.
